REGULATIONS
OF SALES AND PROVISION OF SERVICES
Laser DeLux

General provisions
1. These regulations for the sale and provision of Laser DeLux services, hereinafter referred to as the ” Regulations “, specify:
  1. rules for using the services provided by Laser DeLux Salons, as well as
  2. rules and procedure for concluding stationary sales contracts with customers in Laser DeLux Salons and
  3. rules for concluding sales contracts between Laser DeLux Salons and Customers, using means of distance communication, and for Customers to use the Online Store located at www.laserdelux.pl .
2. The term ” Laser DeLux Salons ” used in these Regulations means beauty salons run in Poland by the following business entities:

3. A detailed list of Laser DeLux Salons run by the entrepreneurs referred to in point 1.2 is attached as Annex No. 1 to these Regulations.
4. Customers of Laser DeLux Salons are obliged to read the Regulations before using the Services. The Regulations have been made public in each of the Salons, as well as on the website at: www. laserdelux.pl/regulamin-sprzedazy-laser-delux.
Definitions
1. Capitalized expressions used in these Regulations have the following meanings:

Dzień Roboczy	a day that is not Saturday or is not a day off from work under generally applicable law in Poland,
Karta Podarunkowa	service voucher issued by Laser Delux Salons, in paper form (and in the case of its sale via the Online Store – in electronic PDF form), entitling its holder to purchase the Services of the Laser Delux Salon where it was purchased, up to the amount limit expressed in the content service voucher,
Online Order Form	the interactive form referred to in point 8.2.3 of the Regulations, available on the Online Store website, enabling the determination of the terms of the sales contract, including the number of Treatments within the ordered Treatment Package, or the value of the Gift Card, and enabling placing an order for a Treatment Package or a Gift Card. ,
Client	a natural person concluding a sales contract with the Laser DeLux Salon or using the Laser DeLux Salon Services,
Civil Code	Act of 23 April 1964 Civil Code (Journal of Laws of 2019, item 1145 – consolidated text)
Consumer	a natural person who concludes a sales contract with the Laser DeLux Salon, the subject of which is not directly related to his or her business or professional activity
Treatment Package	a larger number of Treatments (from 3 to 48) sold by Laser Delux Salons as part of a one-time paid package, the price of which is lower than the sum of the unit prices of individual Treatments included in a given package,
Order confirmation	e-mail sent by the Seller referred to in point 9.2.2 of the Regulations, containing confirmation of acceptance of the Customer’s offer
Employee	a person providing the Service on behalf and on behalf of the Salon
Statute	these regulations for the provision of Laser DeLux services
Salon Laser DeLux lub Salon	each of the showrooms run by entrepreneurs referred to in point 1.2 of the Regulations, listed in Annex No. 1 to these Regulations
Online shop	online store run by Laser DeLux Salons at www.laserdelux.pl
Seller	one of the entrepreneurs referred to in point 1.2 of the Regulations, running the Laser DeLux Salon whose Services the Customer intends to use, selected by the Customer via the form on the Online Store website
Services	services provided in the Stores as part of the business activities conducted by entrepreneurs referred to in point 1.2 of the Regulations, listed in Annex No. 1 to these Regulations
Procedure	cosmetic body care activity performed at the Client’s premises as part of the Services provided by the Salon

Performing Treatments
1. The Salon may make the performance of the Treatment at the Client’s premises conditional on a prior interview with the Client. The subject of the interview is to determine or exclude the existence of contraindications to the Procedure, as well as to determine whether the Procedure does not pose a risk of side effects. Based on the data from the interview, the employee also establishes peri-procedure recommendations.
2. As part of the oral interview, as well as in the content of medical history cards, treatment cards, etc. completed by the Client or with his participation, the Client is obliged to provide the Employee with true information, to the best of his knowledge. The salon is not responsible for the consequences of the Treatment, including side effects, the sole cause of which is the Customer’s conscious provision of false information.
3. If a series of Treatments are performed at the Client’s site at intervals, before starting the next Treatment, the Client is obliged to inform the Employee about any changes in the information provided during the interview that have occurred since the interview.
4. The Salon may make the performance of the Treatment at the Client’s premises conditional on the Client’s submission to the so-called trial. A trial of the treatment involves performing a cosmetic procedure on a small part of the client’s body in order to assess the client’s reaction to the treatment, including the risk of side effects or peri-treatment complications.
5. The salon has the right to refuse to perform the Treatment in the event of:
  1. the Customer’s refusal to provide the information referred to in point 3.1 above, and also
  2. when the circumstances clearly indicate that the information provided by the Customer referred to in point 3.1 above is false, or
  3. in case of other doubts of the Employee as to the possibility of safely performing the Treatment at the Client’s place
6. During the procedure, the Client is obliged to immediately inform the Employee performing the Treatment about any deterioration in well-being, excessive pain or other disturbing symptoms.
7. The employee is obliged to provide the Client with all information about the Procedure being performed, including information about the risks resulting from its implementation, including possible side effects and contraindications. The client has the right to information about the method of performing the Treatment, including the parameters at which the Treatment is performed.
Liability of Laser DeLux Salons
1. Subject to point 3.2 of the Regulations, Laser DeLux Salons are liable for improper performance of Treatments.
2. To avoid any doubts, Laser DeLux Salons stipulate that improper performance of the Service does not constitute failure to achieve the effect of the Treatment expected subjectively by the Client, provided that the Treatment was carried out in a manner consistent with the principles of art and with the utmost care of a professional.
3. In the event of any undesirable consequences of the Treatment, the Client should immediately contact the Laser DeLux Salon where the Treatment was performed, in order to assess the effects of the Treatment and the causes of the consequences, and determine how to proceed further.
4. Complaints regarding treatments performed may be reported orally or in writing to the Laser DeLux Salon that performed the treatment. All complaints will be considered within 14 days from the date of notification.
General terms and conditions of sale of Services
1. Agreements between Customers and Laser DeLux Salons are concluded in Polish.
2. Subject to point 5.4 below, the Customer may use the Services purchased in Laser DeLux salons within 2 years from the date of purchase. However, after making the payment for the Service, the Customer should make an appointment for the first date of the Service (Treatment date) within 3 months. The customer can do it by phone, directly with the salon staff, using online means – LiveChat, social media, e-mail, Moment.pl reservation system.
3. Gift Cards have a limited validity period indicated in their content, which is determined individually, but cannot be longer than 6 months. The holder of the Gift Card may, during its validity period, redeem the Gift Card by exchanging it for a Treatment or Treatment Package (depending on the value of the Gift Card). The exchange of the Gift Card for a Treatment or Treatment Package is made upon arranging the date of the first Treatment. If the Gift Card is exchanged for several Treatments or a Treatment Package, all Treatments should be used within 2 (two) years from the date of redeeming the Gift Card (making an appointment for the first Treatment).
4. Services may be sold as part of limited-time promotional offers. If promotional offers are introduced, detailed terms and conditions of the promotion are provided on the website www.laserdelux.pl and available in Laser DeLux Salons. For Services sold on promotional terms, the deadlines referred to in this point.
5. Treatments, Treatment Packages and Gift Cards can only be used in the Laser Delux Salon where they were purchased. The above also applies to Treatments, Treatment Packages and Gift Cards purchased through the Online Store, in which the Customer indicates the Laser Delux Salon whose Services he/she wants to use. The performance of Treatments, Treatment Packages or the use of Gift Cards in a Laser Delux Salon other than the Laser Delux Salon where they were purchased is possible in individual cases, only with the express consent of the Laser Delux Salon whose Services the Customer ultimately wants to use.
6. If the Customer resigns from some of the Treatments purchased as part of the Treatment Package (in the event of partial use of the Treatment Package), the Seller returns to the Customer the difference between the price of the purchased Treatment Package and the regular price of the treatments performed, calculated on the basis of the regular prices of individual Treatments from the date of purchase of the Package. Treatments. In such a case, in order to make a refund, the Customer must have proof of purchase of the Service (receipt, VAT invoice, Order Confirmation). The Customer’s right referred to in this point does not exclude the right to withdraw from the distance sales contract concluded in the Online Store, referred to in point 10 of the Regulations.
7. The provisions of this point 5 of the Regulations do not prejudice the provisions on the liability of Laser DeLux Salons for the consequences of non-performance or improper performance of the Services.

Sale of Services in stationary Laser DeLux Salons
1. Information about Services sold in stationary Laser DeLux Salons and information on current promotions can be found in the Salons and on the website www.laserdelux.pl.
2. Services are sold in stationary Laser DeLux salons in the form of:
  1. single Treatments,
  2. Treatment Packages, stay in shape
  3. Gift Cards.
3. Payments for the Services may be made by cash, payment card, credit card, gift card or online transfer. In selected Salons, payment in installments is possible. The prices of the Services are given in Polish zloty and include the applicable VAT (gross prices).
4. For each purchased Service, the buyer will receive a receipt or a VAT invoice. In order to obtain a VAT invoice, the Customer is obliged to inform the Store staff about this fact when making the payment.
Sales in the Online Store
1. All information contained on the Online Store’s website, relating to Treatment Packages and Gift Cards (including prices), does not constitute a commercial offer within the meaning of Art. 66 of the Civil Code, but an invitation to conclude a contract referred to in Art. 71 of the Civil Code.
2. Through the Online Store, Laser DeLux Salons sell Treatment Packages and Gift Cards. All prices in the Online Store are given in Polish zloty and are gross prices (including VAT).
3. Confirmation of the purchase of Treatment Packages and Gift Cards, authorizing the Customer to use the Services under the terms of these Regulations, is provided to the Customer only in electronic version. Laser DeLux salons do not charge any fees for the delivery of the above. purchase confirmations.
4. To use the Online Store, the Customer must have:
  1. end device with access to the Internet equipped with a web browser (version no lower than: Firefox 76, Chrome 81, Microsoft Edge 81, Safari 13) with the so-called cookies,
  2. active e-mail account,
5. To open an electronic gift card in PDF (Portable Document Format) format, you need the free Adobe Acrobat Reader application or other software that supports this file format (e.g. Chrome browser).
6. The Seller is not liable for any disruptions, including interruptions, in the operation of the Online Store caused by force majeure, illegal actions of third parties or incompatibility of the Online Store’s infrastructure with the Customer’s technical infrastructure.
Placing orders in the Online Store
1. An order for a Treatment Package can be placed in the Online Store from the “Price List” tab or the “Special Offers” tab and the “Laser hair removal” and “Laser hair removal for men” tabs. An order for a Gift Card can be placed in the Online Store from the “Special Offers” tab.
2. In order to place an order, the Customer should:
  1. on the main page www.laserdelux.pl, select the city and the Seller (the specific Laser DeLux Salon whose Services the Customer intends to use), the customer can also select the city by selecting other tabs, e.g. PRICE LIST,
  2. click the “Buy Online” button next to the selected Treatment Package or Gift Card,
  3. complete the online Order Form containing the following data:
    1. the city in which the Customer wants to provide the Service,
    2. the number of Treatments within the ordered Treatment Package, or the value of the ordered Gift Card,
    3. Customer’s name and surname,
    4. Customer’s telephone number,
    5. the Customer’s e-mail address,
  4. click the “Buy and Pay” button,
  5. make payment for the ordered Treatment Package or Gift Card via the BlueMedia online payment system.
3. The order will be processed after the payment is credited to the Seller’s bank account.
Conclusion of a sales contract via the Online Store
1. Sending the order by the Customer (approval of the online Order Form by clicking the “Buy and Pay” button)) constitutes the Customer’s offer to the Seller to conclude a sales contract, in accordance with the content of these Regulations.
2. After sending the order, the Customer receives the following e-mail address at the e-mail address provided by him:
  1. an e-mail from the payment operator informing about the start of the payment process or (and) an e-mail from the payment operator informing about accepting the payment and posting the payment,
  2. an e-mail from the Seller containing confirmation of acceptance of his offer (hereinafter referred to as the “Purchase Confirmation”) electronically, which constitutes acceptance of the order and at the same time confirmation of concluding a sales contract with the Customer for the Treatment Package or Gift Card,
3. The e-mail message referred to in point 9.2.2 of the Regulations constitutes a confirmation of the purchase of the Treatment Package, authorizing the use of the Seller’s Services under the conditions specified in these Regulations, including point 5 of the Regulations.
4. In the case of purchasing a Gift Card, the e-mail message referred to in the point Error: Source of cancellation of the Regulations not found will be accompanied by a gift card in PDF format containing the data indicated by the Customer in the content of the Online Order Form or data provided by the Customer by telephone.
5. The e-mail message referred to in the point Error: Source of cancellation of the Regulations not found is sent by the Seller manually, which means that it is not generated by the automatic postal system. Due to the above, Laser DeLux Salons reserve that the above-mentioned an e-mail will be sent to the Customer no later than within one (1) Business Day from the date the payment is credited to the Seller’s bank account.
Withdrawal from a distance contract
1. In accordance with the provisions of the Act of May 30, 2014 on consumer rights (Journal of Laws of 2014, item 827), within fourteen days of receiving the ordered Treatment Package or Gift Card, the Consumer has the right to withdraw from the contract concluded on distance and return of this Treatment Package or Gift Card without giving reasons and without incurring costs, subject to the provisions of Art. 33, art. 34 section 2 and 35 of the Consumer Rights Act. The right of withdrawal indicated in this point applies only to consumer sales, and therefore applies only to distance sales contracts concluded with the consumer in accordance with. provisions of the Civil Code.
2. The above right may be exercised by the Consumer by sending a written declaration of withdrawal from the sales contract to the Seller’s address indicated in the Purchase Confirmation. In the event of the Consumer sending the above by mistake. declaration, not to the address of the Seller, but to the address of any of the Laser Delux Salons listed in Appendix 1 to the Regulations, the declaration will be considered effectively submitted. The appropriate withdrawal form from the sales contract is sent to the Consumer via e-mail along with the Purchase Confirmation referred to in point 9.2.2 of the Regulations. The consumer has the right to withdraw from the sales contract also using the withdrawal form included in Annex 2 to the Consumer Rights Act.
3. The above-mentioned 14-day period is counted from the day on which the Consumer received the e-mail referred to in point 9.2.2 of the Regulations (Confirmation of Purchase). To meet this deadline, it is sufficient to send the Seller information regarding the exercise of the Consumer’s right to withdraw from the contract before the deadline for withdrawal from the contract expires.
4. In the event of withdrawal from a distance sales contract, the contract is considered not concluded and the payments made by the Consumer are refunded. In such a case, the Treatment Package or Gift Card delivered to the Consumer is canceled by the Seller, which does not require any additional actions on the part of the Consumer.
5. The refund of the payment to the Consumer and the cancellation of the Treatment Package or Gift Card should take place immediately, no later than within fourteen (14) days from the date of receipt by the Seller of the Consumer’s declaration of withdrawal from the sales contract.
Complaints
1. Laser DeLux Salons undertake to provide customers with Treatment Packages or Gift Cards free from defects and are liable if the sold Treatment Packages or Gift Cards have a physical or legal defect (warranty for defects).
2. Complaints arising from the violation of the Customer’s rights arising from generally applicable provisions of law or from the content of these Regulations should be sent to the address or e-mail address of the Seller (specific Laser DeLux Salon whose Services the Customer intends to use) indicated in the content of the e-mail message, referred to in point 9.2.2 of the Regulations, as well as in Annex No. 1 to the Regulations).
3. The Seller undertakes to consider each complaint within 14 days.
Out-of-court methods of dealing with complaints and pursuing claims
1. The consumer has the opportunity to use out-of-court methods of dealing with complaints and redress, and in this respect he has the following examples of options for using out-of-court methods of dealing with complaints and redress:
  1. submitting a request to a permanent consumer arbitration court to resolve a dispute arising from the concluded sales contract,
  2. using the assistance of a district (municipal) consumer ombudsman or a social organization whose statutory tasks include consumer protection
2. Detailed information on out-of-court methods of dealing with complaints and pursuing claims can be obtained by the Consumer on the website: www.uokik.gov.pl/sprawy_indywidualne.php.
Processing of personal data
1. In connection with concluding distance sales contracts (via the Online Store), Laser DeLux Salons process Customers’ personal data in accordance with and under the conditions specified in applicable law and described in the Privacy and Cookie Policy at https://www.laserdelux.pl/privaty- privacy-and-cookie .
2. Any questions related to the processing of personal data by Laser DeLux should be sent to marketing@laserdelux.pl
Final Provisions
1. Any questions and comments regarding the operation of Laser DeLux Salons can be sent to the following e-mail address: marketing@laserdelux.pl
2. Laser DeLux salons reserve the right to make changes to the Regulations . In the event of changes to the Regulations , they shall enter into force on the date indicated in the information on the amendment to the Regulations published on the website www.laserdelux.pl , however, to orders placed before the amendments to the Regulations enter into force, the provisions of the Regulations in the applicable version shall apply. at the time of placing the order.
3. In matters not regulated by these Regulations, the relevant provisions of the Civil Code and the Act of May 30, 2014 on consumer rights (Journal of Laws of 2020, item 287 – consolidated text) will apply.
4. These Regulations are valid from May 11, 2020.
